GENERAL TERMS AND CONDITIONS – LUMIX24

1. Definitions

In these General Terms and Conditions, the following definitions apply: LUMIX24: the supplier of products and services, established in the Netherlands. Customer: any natural or legal person who purchases products or services. Agreement: any arrangement between LUMIX24 and the Customer. Products: all goods supplied by LUMIX24.

2. Applicability

These General Terms and Conditions apply to all quotations, orders, agreements, and deliveries of LUMIX24. Deviations are only valid if agreed upon in writing. The applicability of any terms and conditions of the Customer is expressly excluded.

3. Offers and prices

All prices are exclusive of VAT and shipping costs unless stated otherwise. Prices may be changed as long as no agreement has been concluded. Obvious errors or mistakes in the offer do not bind LUMIX24.

4. Orders and agreements

An agreement is established once LUMIX24 confirms the order in writing. LUMIX24 reserves the right to refuse orders without stating a reason.

5. Payment

Payment must be made before delivery, unless otherwise agreed. In case of late payment, the Customer is immediately in default and statutory (commercial) interest is due. All collection costs are payable by the Customer.

6. Delivery and delivery times

Delivery times are indicative and not strict deadlines. Exceeding delivery times does not entitle the Customer to compensation or termination. Delivery takes place at the address provided by the Customer. The risk of loss or damage transfers to the Customer at the moment of delivery.

7. Transport and damage

The Customer must inspect the goods upon receipt. Any damage or shortages must be reported in writing within 48 hours. Visible transport damage must be noted immediately on the delivery note.

8. Returns

Returns are only accepted after written approval from LUMIX24. Custom-made or specially ordered products cannot be returned. Return costs are borne by the Customer unless otherwise agreed.

9. Warranty

LUMIX24 supplies according to the manufacturer’s warranty of the respective products. Warranty does not apply in cases of:

improper use,

installation errors,

insufficient maintenance,

damage caused by moisture, heat, or improper storage.

10. Liability

LUMIX24 is not liable for indirect damage, consequential damage, or loss of profit. Liability is always limited to the invoice amount of the relevant delivery. The Customer is responsible for correct installation and application of the products.

11. Force majeure

In the event of force majeure (such as strikes, transport issues, natural disasters, war, pandemics), LUMIX24 may suspend or terminate the agreement without being liable for damages.

12. Intellectual property

All texts, photos, designs, and materials on the website remain the property of LUMIX24. Use without permission is not allowed.

13. Applicable law

All agreements are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in the Netherlands.
